Welcome to www.werrc.com (the “Site”), operated by WE R HOBBIES, LLC DBA WE R RC (“WE R RC,” “we,” “us,” or “our”). By accessing this Site, purchasing products, subscribing to services, or using our facilities (including race tracks and drift track), you agree to the following Terms & Conditions.

1. General Use of Website

All information provided on this Site is for informational and commercial purposes only. WE R RC makes no representations or warranties regarding accuracy, completeness, or reliability.

WE R RC reserves the right to:

• Modify or update content at any time
• Refuse service to anyone
• Cancel orders
• Limit quantities
• Correct pricing errors
• Restrict sales due to suspected fraud, abuse, or resale activity

2. Product Information & Pricing

Product descriptions, pricing, and availability may change without notice and may contain errors. WE R RC reserves the right to cancel or refuse any order due to inaccuracies or pricing errors.

All products are sold “AS IS” and “AS AVAILABLE” without warranties, express or implied.

3. Return Policy

Returns are accepted only if the product is:

• Unused
• Unopened
• In original manufacturer packaging
• In brand new, resalable condition

Products showing installation, use, modification, wear, or damage will not be accepted.

Return requests must be made within 14 days of delivery or purchase.

All returns require prior approval by emailing: info@werrc.com

Customers are responsible for return shipping costs.

Original shipping fees are non-refundable. If free shipping was provided, actual outbound shipping costs may be deducted from the refund.

Refunds will not be issued until item(s) are received and inspected.

Non-returnable items include:

• Opened electronics (ESCs, receivers, radios, batteries, chargers)
• Installed parts
• Special or custom orders
• Clearance items
• Fuel, adhesives, chemicals, consumables
• Gift cards

WE R RC reserves the right to apply up to a 15% restocking fee.

4. Facility Use – Raceway & Drift Track

Use of any WE R RC facility, including but not limited to the on-road track, off-road track, drift track, practice areas, pit areas, and spectator areas, involves inherent risks.

By entering or using the facility, you acknowledge:

• RC vehicles may cause bodily injury or property damage
• You assume all risks associated with participation or spectating
• You are responsible for damage caused by your vehicle or equipment
• You must follow all posted track rules and staff instructions

WE R RC reserves the right to:

• Remove any individual for unsafe behavior
• Deny access at its sole discretion
• Close the facility for events or private functions without compensation
• Modify track rules at any time

No refunds will be issued for removal due to rule violations.

5. Monthly Racers Pass & Drift Pass Subscriptions

By purchasing a Monthly Racers Pass or Drift Pass:

• Access is limited to the subscriber only
• No guest privileges are permitted
• Subscriptions remain active until canceled
• $20 fee applies for lost or damaged key fobs
• Facility closures for events or maintenance do not entitle subscriber to compensation
• Organized races or events may require additional entry fees

Subscribers agree to all facility rules and assume all risks associated with participation.

This agreement remains in effect for all future visits unless replaced by a new agreement.

6. Assumption of Risk

RC vehicles, batteries (including LiPo batteries), fuel, tools, and racing activities involve risks including fire, property damage, and bodily injury.

By purchasing products or using our facilities, you voluntarily assume all risks.

7. Limitation of Liability

To the fullest extent permitted by law, WE R RC shall not be liable for:

• Personal injury
• Property damage
• Loss of profits
• Indirect, incidental, or consequential damages
• Damage resulting from product misuse or modification

8. Billing Disputes & Chargebacks

Customers agree to contact WE R RC at info@werrc.com to attempt resolution of any billing issue prior to initiating a chargeback or credit card dispute.

Nothing in this Agreement limits or waives any rights provided under federal or state law.

Fraudulent chargebacks or disputes for validly delivered merchandise may be pursued to the fullest extent permitted by law.

9. Indemnification

You agree to indemnify and hold harmless WE R RC, its owners, officers, employees, affiliates, and agents from any claims, damages, liabilities, or expenses (including attorney’s fees) arising from:

• Your use of the Site
• Your product use
• Your participation in facility activities
• Your violation of these Terms

10. No Warranty

The Site and all products and services are provided without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose.

11. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania.

All disputes shall be resolved exclusively in state or federal courts located in Pennsylvania.

12. Changes to Terms

WE R RC reserves the right to modify these Terms at any time. Continued use of the Site or facilities constitutes acceptance of updated terms.
